Fiance Visa Divorce Help

Hi,

My name is Hasan. I am a US Citizen from last 10 years. I met my fiance who lives in Morocco via internet. I visited her in Feburary, 2009 and we really liked each other and wanted to get married. The issue is that she is currently married. Her husband lives in Italy and she is waiting for her husband to come to Morocco to file and sign the divorce. Her husband said he will only come in August 2009. She has her greencard for Italy. My question is if the girl goes to Italy, can she file for divorce in Italy and get divorce there? Or does she has to file the divorce in Morocco as they got married in Morocco? Will the US immigration accept the divorce if taken in Italy as valid when I file for her fiance visa? Please advise.

Well from what I know. All moroccan marriages must be nullified in Morocco(the person or power of att)http://www.moroccanconsulate.com/divorce.cfm. I dont know about italian law but the requirements for the usa and morocco is that the woman be single(part of the paperwork for the fiance will be a request for a letter from the moroccan govt proving she is not married) Good luck

Morocco is still a islamic country and can react harsh to any disconduct. It only takes a concerned individual or law official to enforce islamic law by informing the authorities. Divorce doesnt happen overnight in morocco either. As Mister mee-oggee would say:Patience grasshopper
