  • How to legally go to USA as fast as possible?

    Hello,

    I`m from Brazil and went to USA on Aug-2008 under a J-1 visa and I`m under the two-years rules. I met my husband while I was in USA and he came to Brazil where we got married. We want to go back to USA as soon as possible. Firstly I thought about using my B1/B2 visa, but I read that it`s not legal to do that if I intend to stay there. Another thing I read is that the J-1 2 years rules apply for who wants to apply for H or L status.

    I want to know if it`ll be ok if I send the form I-130 and where should I send this form: to USCIS in USA or to the Immigration Embassy here in Brazil? My husband is in Brazil right now and intend to stay here until I can go to USA with him.

      I'm sorry I just wanted to help. That's how i see this sitation. Of course I'm not a specialist, but this forum is for advices from ordinary people dealing with similar situations isn't it?

        Thanks Julia for your attention and thanks Praetorian. I searched about the process and yes Julia my marriage is legal in USA. I need to ask for the USCIS to validate, but I can`t get married again. To get married in any country we need to declare we are single and I`m not.
