  • Naturalization interview Aug 24th, waiting to apply for K1

My naturalization interview is on Aug 24th '09. I have met my fiance over 4 years ago but she was in school so we decided to wait. She has since completed school and is working in India. I met her family with my parents last year with intent to get married. I convinced them to wait till I become a citizen since it is much easier to bring her over here.

I am planning on applying for the K1 visa soon after I get naturalized (hopefully my interview goes well). Is that ok? Will it be too soon to apply or do they even consider that as being too soon after becoming a citizen.

Should I get a lawyer to do my stuff or should I do it myself?

Please let me know how long it usually takes for my fiance to come here. Also if our application gets approved we are planning on performing the marriage cermony in India (without registering it in India) and getting married when she comes to the US. Please give me any information you think I should be aware of.

The K1 usually takes on average 6 months to process between applying and the fiance being issued the visa,

I have heard before of ceremony's being carried out abroad. The US embassy in india will check very carefully to make sure you are not already married.

It is fraudulent and illegal to enter the US on a K1 having previously been married and not declared it or shown documented evidence you have divorced.

I suggest you contact a Lawyer, and look at getting a K3 visa instead of a K1. A K3 visa lets the spouse (that is already married to) a US citizen come to live and work in the US. This would be your safest, and stress free option.

      k1

The fiance visa is the best path to take because it is faster. After the i129f is approve it is vaild for 4 months so that means the the NVC and the embassy where your fiance lives would process the petition ASAP being that they only have the time of 4 months before the petition expires. Certain times the embassy will extend the k1 because of the time it takes to get police clearance. However, you can also, file the k3 and after you get the NOA1 letter turn around and file the k1 with a copy of your NOA 1 form your I-130 petition. This way it a race to see which petition get approve faster but you would have to get marry in India first for this to work.
