OK I've seen this subject on many other forums
There is no law against visiting whilst your k1/k3 is pending, but what you need to do is take with you all relevant paperwork which shows strong evidence that you will be returning home after the trip, this might include
Return Flight booked
Tenancy papers with a letter from your landlord
Mortage Statement
A letter from your employer stating when you are due to return back to work
Pay slips showing you are still paying taxes in your home country
Bank statement showing you still have money in your home country
It is also reccomended that you take with you any documentation relating to your visa application... i.e. a copy of the receipt from UCSIS.
When entering the US at immigration, you should state the reason of your visit and of course ALWAYS tell the truth, but it is not compulsary to mention that you have applied for a visa, but if asked, you should be completley honest and open.
There have been cases whereby people have been denied entry because they did not have enough evidence that they were returning to their home country after the visit.
I am visiting my fiance shortly with a K1 pending and will share my experience at the border on my return.
