    Hello,

    I am a US citizen and have applied for my spouse in India for immigrant visa. Our documents have been verified and were completed thru NVC on Aug 14th, 09. We are waiting for an interview date now.

    My questions:

    1. Approximately, what could be his interview date ? Any hunch ?

    2. I am working here in USA. It's been 8 months, since I came back from India after getting married. My question is, in his interview, will he be asked about my current job and financial status ? If yes, then I need to stay and keep my current job, right ? The reason I am asking is, I was thinking of going and staying with him there in India, untill he gets his visa, then flying back together. In order to do that, i will have to resign from my current job. My fear is what if the officer at embassy asks my Spouse about the support question during the interview. If I resign now and go, he will not be able to provide any supporting documents about the support question.

    Any help will be greately appreciated. Thanks.

      You show financial support with the I-864 or the I-34 forms. The main supporting documents that you send to your spouse with those is copies of your federal income tax returns.

      Quiting your job today does not affect last years income tax return so I don't think the embassy will know about your current lack of income. I would suggest contacting the embassy in India to see how busy they are and maybe they could give you a clue about the current schedule.

        The Affidavit of Support normally requires something other than a tax return. They would like to see other proofs such as a letter from your current employer stating your employment status and income, or your most recent pay stubs.

        The visa is just part of the overall process. Once he arrives in the US and you are married, he will need to apply for a green card and work permit. You will fill out an I-864 Affidavit of Support stating your employment and income. And you will provide new proofs of that income. Ideally all of this will be filed within the 90 days he is given on the I-94 card by immigration when he enters the country. If you can't show current income that is 125% above the poverty line, then they can't approve his green card application. It also costs $1010 to apply, so be sure you have that much saved.

        If you can get a co-sponsor to cover the support issues, then you can quit your job.
