  • k1 Time extension

    Hello;
    My financee & i have an interview around the first week of october, and it will be one year 11-18-09 in that our petition was approved. The problem is that we're having some problems and wondering if we somehow can get more time. The interview would be in manilla, and like i said it will be a whole year that the petition has been approved 11-18-09. They told her at the embassy that we had a year to use it. Can u do anything to extend time or do we try for the visa, or just let it go, and maybe try the whole process again. Unfortuately we're having issues that have come up. My thougths are possibly to try to get the visa, since it's the last step, and if we decide it's not best to marry just not use it. I understand that it is useable for 6 months. Thanks for any input.

    The petition approval is good for 4 months. If you look at the notice that said the I-129f was approved, it has an expiration date printed on it. The Embassy can allow an extension, especially if it was the Embassy's fault for not sending you an interview or delaying you. If you have an interview scheduled, then you're okay and the Embassy is obviously allowing it. But in cases where that much time has passed, they often want to see an updated letter of intent that the US person still wants to marry you, since so much time passed since the approval.

    You can write the Embassy for an extension and a later appointment. Maybe they will allow it if you have a good reason other that "we're having issues." You can also get the visa, and have 6 months to use it. You can get the visa, enter the US, not marry and return home before the 90 days are up.

    Best to solve your issues before you spend any more money on this relationship. Most fiance's don't realize how difficult it will be when they get to the US. They are homesick, it's a new culture, they can't work or get a driver's license right away. They are stuck at home all day while the spouse is gone to work. They get very bored, lonely, and homesick. It's very hard even when you are madly in love and committed to each other.

      bad interview timeing

      Thanks for your input;
      I guess my problem at this time is my financee is getting concerned about the whole thing. She's lost her firmness. She still loves me, but she's kind of scared about the whole thing. The interview could be in one week; but i'm afraid she'll blow it. Then if we mature in the relationship, and try again, our relationship would be red-flagged to the embassy, and much more difficult to gain approval. She loved me very deeply, but then got hurt, & as we try to repair, we have a bad timeing issue. I hate to let the opportunity pass by, but it's also a bad time for her to try to go, & it could do more damage then good. ? Thks for any input;

        re-instating a withdrawn petition?

        Hello;
        To further develope things, my financee went for the interview, & ended up withdrawing the petition. Now she seems to be allowing the relationship to be restored. If we had until 11-18-09 for the visa time wise, & she withdrew the petition; is there any way to re-instate it before the 11-18-09; or would we have to start all over again with no chance for the first seeing she withdrew it? I know it might be to soon in the relationships healing to try again for the first petition, but it was of course alot of time, effort and money to do and i'm wondering if it's possible.
        Thks for any comment
