  • Form I-134, question 8 (K-1 fiance visa)

    I'm a little confusing about question 8 of form I-134. Hopefully someone will be able to help me. I had 2 children (one is 21 and the other is 17) with my ex-girlfriend (we never married) and the children have been living with their mother. I've been paying child support and never claimed my children as my dependents on my income tax returns. Do I have to list my children in question# 8? and if I do so, which option I should choose? Wholly Dependent or Partially Dependent?

    If you will look at the I-864 Affidavit of Support, there are more instructions which would be helpful in filling out the I-134 because they are very similiar documents.

    "Your household size includes yourself and the following individuals, no matter where they live: any spouse, any dependent children under the age of 21, any other dependents listed on your most recent Federal income tax return, all persons being sponsored in this affidavit of support, and any immigrants previously sponsored with a Form I-864 or FormI-864 EZ affidavit of support whom you are still obligated to support."

    Logic tell me that the 17 year old is still partially dependent on you.
