  • Former H1 needs Police clearance from US for K1 / K3?

    Hello,

I had worked in US from 2001-2002(1.5yrs) on H1.Since Aften then I am working In India.

I read the following on this site ::-

" Present and former residents of the United States should NOT obtain any police certificates covering their residence in the US."

    Is this right?

    I plan to apply for K1 / K3.

Does it mean I dont need to take police clearance from USA, at the time of interview in India?

    Appreciate your thoughts.

    Regards,
    Mudita

That is correct. You do not get any certificate from the US. As part of the process your name will be run through multiple US databases including clearance by FBI namechecks.

The Dept of State website has the following concerning police certificates--

Note: Present and former residents of the United States should NOT obtain any police certificates covering their residence in the U.S.

The DOS is the authority on who gets a visa, as visas are issued by them via the Embassy.

        thanks nichole..

thank you very much nichole for the answer. I am glad to know that we dont need to get the Police Clearance from USA. so that reduces lot of headache.

All I would need now is from India. Complication is :--

My passport is made in Bangalore, India where I lived for 3 yrs but now i am living in Delhi, India for past 3 yrs.

Do I need Police Clearance's from Bangalore and Delhi , Both?

And secondly , Does the Corresponding Passport offices issue the Police clearance certificates OR the local Police Stations?

        Regards,
        Mudita

From the website US Embassy New Delhi, India:

          Police Certificates
Each visa applicant over the age of 16 must present police certificates. Police certificates must cover the entire period of the applicant's residence in any area. The term "police certificate" means a certification by appropriate police authorities stating what their records show concerning each applicant, including all arrests, the reasons for the arrests, and the disposition of each case of which there is a record. Police certificates from certain countries are considered unobtainable.

          Frequently Asked Questions:

Do I need a police clearance certificate from India for an immigrant visa?

Yes. If you are an Indian citizens age 16 or older and currently residing in India, with a passport issued MORE THAN six months prior to your interview date, you should obtain a police clearance certificate from BOTH the nearest Indian Passport Office and the District Police in the area in which you reside. However, if your passport was issued LESS THAN six months prior to your interview date, you only need a police clearance certificate from your nearest Indian Passport Office.

If I have lived in another country besides India, do I need a police clearance certificate from that country for an immigrant visa?

In most cases, you require a police certificate from any third country in which you have lived for 12 or more months.. In some cases, police certificates are unobtainable.

            thanks....

            hey nichole,

i was touched by seeing your efforts as u went to the new delhi site and found an answer for me. Thanks very much. Very very kind of you.

I read this, but I am still confused, based on my situation, where my passports address is that of Bangalore, and I am now in Delhi,

Do I need 4 police certificates like:-
            1. Passport office in Bangalore
            2. Passport office in Delhi
            3. District Local Police station in Bangalore where I resided
            4. District Local Police station in Delhi where I reside

            :-) complicated right?

OR I need much less than I am thinking !!! :-)

            Please suggest.

            Regards,
            Mudita

I don't know India and only put what I found on the website. I wish an Indian would reply.

In general they want to see a police certificate from every place lived, meaning city (as well as country). People in the United Kingdom used to have to get one from the local police station in every town where they lived since age 16. Then they made a new central location to cover the whole country so you could get just one to cover any place you lived in the UK.

I don't know how it works in India. If you got it from the passport office in Delhi, would it cover all cities in India in the report? I think I would ring up the passport office and police station in Delhi and ask if their report would cover the whole country or just incidents in Delhi. That might help you decide what you need.
