Hello the list, many of my questions have been answered by this forum, and I am thankful for you. I have one more question for the list.
My fiance has been in this country illegally one time, from late 1989 to early 1991. She had a debt to pay, came here and got a job, and when the debt was paid, she went back to Mexico on her own.
My quesition is this. Is this going to affect her status for a K1 visa? If she is rejected for this, what is our next step? Many thanks in advance,
    Bryan

    Hi Bryan

This is my first post and i have no expert knowledge of legalities or how honestly your forms were filled out. However i have been refused entry to the USA as a tourist in 2008 (& swiftly deported )and my Fiance in California has still since sucessfully petitioned me.

I didn't overstay or work, i got caught at the first airport with a copy of my Resume'/CV in my luggage and got shipped back home without any possible argument.

I've just filled out my embassy interview forms last week and got my medical interview date(22nd December) I was completely honest on my forms and mentioned my refused entry and specifics. It did mention that i might have to speak with a consular officer at my port of entry if i get final approval but that i certainly wasn't ruled out! Tell your fiance not to worry just don't lie or gloss over that you might get caught out with at an interview or you'll be back to waiting months and maybe trying another visa route.

My big red "refused" stamp in my passport is probably worse than hers 19 years earlier and i still feel confident about a sucessful embassy interview, because i was honest on my forms and will be honest at the interview. Just before she signs her name she'll have to swear that she's telling the truth. It won't be worse to be refused early than any of the other possibilities that could happen.

Many thanks for the post. I will not lie or gloss over the truth, this is not my way. It has been a LONG time since Maria has been here, about 20 years, give or take a little, so I think we will be ok, but my mother hen mentality rears it's ugly head, and I do so want to get this done the first time. I'm just like the guy at the circus that spins the plates on the sticks, I am trying to remember everything we have to do, and to do a good job of CYA. Thanks again. Anyone else?
