  • K1 question about the scheduled interview

    Hello!

My question could seem stupid but I'm very worried about it.

My American fiancè would submit a request for a Visa K1 next month.

Now, we've already met each other in the US last month and he has bought a flight to see me again in May.

What if they schedule my appointment when he is here ? I live in another city far from the only Embassy that gives this kind of Visas and it would be a big problem for the both of us to get there.

Is there any way to choose with the Embassy a good date or should I be absolutely available and go when they tell me to ?

    Just a little advice

i'm not sure where you are located, and how long the visit will be in the US, but most countries, you have to wait for your packet 3 to arrive in the mail, and send information back to the embassy.....then some countries you have to also wait for packet 4, and send back a "checklist" that is signed by the alien fiance. Most (not all) require this before they schedule your interview! If you delay sending this, you can delay your interview date. But, there is no way telling what can happen between now and then either! The USCIS could Request more evidence, you could get stuck in AP with the NVC.......The embassy lost our checklist so this put us back a few weeks....many things can happen. I would plan your trip......BUT.....Do realize if you have a K1 out there, the alien fiance could get sent back to his country by immigration. Make sure you have proof that he is going back to his country like his/her lease for their apartment, don't bring a lot of cash, and no personal belongings. Also, for your K1 petition....include tons of evidence of your bonafide relationship right away so the USCIS doesn't need more! We thought that we had enough, and they wanted more! Good luck.......

Okay, thank you ! So I could just take some more time before sending all the forms to the American Embassy in Italy ( that's were I am ).

My boyfriend already bought his tickets for May and he should submit his request at the beginning of next month.

Could his flight ticket back to his city (Jacksonville) be enough to prove that he came back ? Maybe he could have a proof that he'll use his credit card here and that he'll use it again in the U.S. after May. I don't see many other ways to prove this since he's going to stay in my apartment in those two weeks.

Thank you for your answer !

I'm so scared about this procedure, I hope it won't last too long !!

I'm sorry I just realized that I haven't been clear enough ( I do my best to be understandable but English is not my native language ! ).

I went to the US in December and he'll come here in Italy in May

We'll see each other 2 times before my interview at the Embassy in total, so I hope that it would be enough for them to have our flight tickets, the picture of us in Jax and then here, e-mails, mails... I can't see what else to show them !!

Make a photocopy of the passport pages with "IN" and "OUT" stamps in both passports as the case may be. That is more powerful than boarding passes IMHO. That is what we did.

Re: K1 question about the scheduled interview

            Hi.

From what I understand, your fiance has not submitted the I-129F petition with USCIS yet. From my experience, once a K-1 application is filed it takes approximately five months for processing to take place at the Service Center. After which, if approved, the petition will be sent to NVC for more processing. After USCIS and NVC are done with the application, then it goes to the U.S. embassy for interview. So if your fiance has not filed yet, it is a little difficult to tell when your interview appointment will come. When you submit the application make sure that you submit as much documentary evidence as possible. Pictures, emails, telephone records, receipts of gifts bought for each other, etc, all count. This is just my personal opinion but don't worry about the interview just yet. Make sure that your petition is sent in correctly. If USCIS wants more evidence of the relationship, it will cause a lot of delay in the processing.
