  • Administrative Processing in Delhi K1 Visa

    Hello,
    My fiance had his interview in Delhi on Oct 21 2009, he was asked to provide more proof of the relationship, which we did 2 days later. Our case has been under Administrative Processing ever since and I can't get any other information for the Consulate.
    Is this normal? It seems like an awfully long time to process and application. I am worried that it has been lost or misplaced and not even being worked on....
    I have tried talking with Supervisors at the Consulate but they all say the same thing; it's being processed.
    Help?

      Is this normal for the Embassy?
      I was calling them weekly and sending emails too. I will continue to call and encourage my fiance to do so as well.

        The squeaky wheel gets the oil. So, keep asking. Can you visit in person to inquire? Assuming you are the US citizen in which case you cannot be denied access.

          Yes I am the US citizen. I plan to go end of Feb if we get no results with my weekly phone calls and emails.

          As a US citizen I can just go without an appointment and ask to speak with someone about my case?? Good to know!

              Done

              I was able to get the attention of a US Diplomat by making an accusation of discrimination; which I honestly believed to be the truth. In any case my fiance had his Visa 2 weeks later.

                Glad to know that you got the K1 visa

                Hi,

                I read lot of bad experience in this site for K1 visa from delhi consultate.

                I am USA citizen since 2007 and planning to remarry a girl from india. we both have kids from earlier marriage. I am planning to sponsor a K1 visa as it is the quicklest way to bring someone to USA to get married.

                My question is

                1. Please share you timeline how much time it took from the day you applied and got the K1 visa stamped in delhi consulate. To my understanding get the visa stamped in delhi is the toughest process in K1 visa

                2. What documentation they are looking to prove the relationship is legitemate. Do we have to get engaged in india. Since it is a remarriage we are planning to skip the engagement and get married in USA

                3. Any other things we should be careful.

                It is not only me but there are several people would benifit from your reply.

                  Hello,

                  It took exactly 11 months from the time I petitioned to the time he received his Visa. And yes getting a Visa approved in Delhi was THE Hardest part!! They are very slow and seemingly unconcerned.

                  I don't think you have to get engaged in India but you do have to provide letters from each of you saying how you met, why you decided to become engaged and what your future intentions are.

                  Documentation: is your friend in this process as they see proof as being on paper.
                  Prove you know each other with photo's of the 2 of you together and preferably with friends and family if possible. Print any and all emails you exchanged, as well as cards or letters mailed via postal services. Also provide phone records, I printed out months worth of Skype phone calls. I also screen printed some ******** exchanges that showed proof of public acknowledgment of our relationship and that my friends also participated in.

                  Most helpful and key I think are letters from important family members approving your engagement and future marriage . i.e. parents, grandparents, siblings. Also letters written by each of you stating how you met, how your relationship developed and why you have decided to marry. These documents should be notarized and submitted before the interview. Make copies of everything for your own records!!! They may lose something.

                  Interview: is also very important and the part that hung us up for 4 months! Make sure that you have all of your documentation correct and submitted prior to the Visa interview. They will include instructions on what needs to happen prior to the interview.
                  Make sure your fiancé knows simple things like how old you are, how old your children are, where you work or what kind of work you do, where you live, were born etc….They will ask questions any idiot could memorize and not what you would think they would ask.

                    If I submit all the documents before the interview, will they still delay it. Can I get a letter from the local senator and fax it to new delhi consulate. Do you think that will expediate the process...

                      I really don't recall what NOA1 ,2 and packets 3,4 were all about and without searching through my files can't answer specifically to those.
                      You can do whatever you feel you must in order to expedite the process, however, I think it's important to know that there are some things you will not be able to change. The way India works even though it's a US Embassy is very different from the way things work in the US.
                      There is nothing to suggest that anything would be delayed as long as you have provided everything they are looking for. The information I shared with you was based on my learnings and the mistakes we made. If everything is in order at the interview she may get approved then. It all depends on whether or not the diplomat interviewing her believes her story right then and there and she will have approximately 2-5 minutes in which to do this. Reality is that they interview many many people every day and have little time for extended chats. If there is a shred of doubt in the interviewers mind your process will immediately slow as they endeavor to prove legitimacy. this involves fact checking and phone calling of listed supporters etc...so get it right the first time if possible.

                      The original K1 petition took 3 months to approve (this is less than the average). He had his interview 2.5 months later and because he was unable to answer questions sufficiently we had to submit more documented proof.
                      This is where our process slowed to a halt and required lots of pushing from my end.
                      Four months after the interview debacle the Visa was issued.
                      Every case is going to be different so I would suggest you not get your hopes up that you will be able to make things go according to your time line otherwise you will be incredibly frustrated. It's India....things move way slower than in the US. Reality like it or not.
