  • Voluntary Departure and K-1 Visa Question

A friend of mine who wishes to marry me came to visit the US on a vistor visa. At the port of entry they denied him to enter because he appeared to be an intending immigrant. They stated that the following evidence led to thier conclusion. He has a saree that resembled a wedding saree, he had a resignation letter from his job, a birth certificate and the evidence goes on. So I understand the Border controls perspective my question is this.

If we do intend to marry how will his voluntary departure impact the K-1 visa process? They cancelled his B2 Visa and said he has no black marks on his record he just needs to apply for a new visa. Does anyone any experience with this? There are no bars on him from entering the US.

My attny said no problem we will just file for a K1 Visa.

Had he been allowed to enter the US on the B2 and married you, then you could have had problems. As it is now, it should have no effect on your application.
