  • Bringing Husband to USA

I am a U.S. Citizen and wish to bring my husband to the United States. My husband was bon and raised in Pakistan but is now living in Saudi Arab since one month on business visa. I am confused as if I should apply for him from Saudi Arab or Pakistan?

Also on the website "I saw you just file I-130, but here on the form I read you can file I-130 and I-129F together? What do I do?

    Thanks much!!!

You apply from here, the US.

Spouse should do his paperwork from Pakistan.

Choose from K3 visa or consular processing.

You file an I-130 petition to USCIS from the US with either the California Service Center or the Vermont Service center depending on the state where you live. Read the instructions for the form and it will tell you where to send it. Once you get a receipt form back, then you can file the I-129F petition along with that receipt for the I-130 if you want a K3 visa for your husband. The I-130 alone will get him a CR1 visa.

Once the petition(s) are approved your husband will have to apply for the visa to the Dept of State through a US Embassy abroad. The Embassy where he will apply and interview should be the closest Embassy to where he is currently living. If he will still be living in Saudi in 4-5 months when the time for his Embassy part comes, then he will use US Embassy Riyadh, Saudi Arabia. You have to put on your first petition which Embassy he will use because they will send the files from the USCIS to the country that you name. He does not have to use the Embassy where he was born. Be sure and list his current address in Saudi on your form if that is where he will be living while this process is going on.
