    I am in the process of gathering all required documentation for the K-1 visa process, and i am only lacking in one area for finishing all initial items, except for performing a criminal background check. What do i need to do, or where do i need to go to get this? I have been to my local police, but they asked me what type do i need, a local, a state, or national background check? And each different type comes with a different price, and waiting period. So can anybody guide me since my immigration attorney does not get back to me in a timely manner. Thanks for your help.

    The US citizen does not need to provide a criminal background check.

    Your spouse will need to provide police certificates for each place he/she has lived. My fiancee's police certificate was fairly simple, it said something like (Name) has no criminal record and is not wanted by the police.
    My Fiancee arrived here on a K-1 VISA.
    Conditional GreenCard has been received.

      are you 100% positive i dont need a background check?

      are you positive that i dont need a criminal background check? My immigration attorney is saying that i do, and the websites that i have researched have said i do so that she knows the type of person that i am, and just in case that i am lying, the background check will prove to her what kind of person i am, but my background check doesnt necessarily mean anything for the process, just gives her the background information on my since we met online. I hope you are right though..... thanks for the post

        I am positive that I did not provied any formal background checks or police certificates. I did mention that I have no criminal background in my letter of intention to marry.

        The revision date for the I-129f form is still 7/30/07 so nothing has changed.


        I don't know what to tell your attorney. I am not giving legal advice just telling my story from my experience.

        I filed the I-129f last year and I was able to bring my fiancee (now wife) to the USA and that we have our green card interview this month.
        My Fiancee arrived here on a K-1 VISA.
        Conditional GreenCard has been received.
