    In 2004 I traveled to the United States (I'm an Australian citizen) on a fiance visa. My then fiance and I married in Feb 2004. I was granted conditional residency (condition being we stay married for 2 years). At the 2 year juncture I had to apply to have the conditional status removed which I did. Because of processing time I was granted an extension on my visa. In march of 2007 my wife and I were having some problems (mostly to do with me losing a close friend back in Australia and becoming very home sick). I had a relative living in Oregon (my wife and I lived in MA) so we decided it best to take a break and I went to stay in Portland. During this time I became more depressed about my situation and decided to move back to Australia at the end of 2007. I still had not been set a date for my final interview concerning the removal of my conditional status. During 2008 I was offered a job which required a 2-4 year commitment and my wife was accepted into a medical program in MA. This made things even more complicated for us. We chose to continue a distance relationship seeing each other every 6 months for 4-8 weeks at a time and continue our work and studies in seperate countries. During the course of 2008 my interview date was set which I had to decline, due to my living circumstances and employment commitments in Australia. So hence my visa was canceled. Towards the end of 2010 I am able to secure a release from my working contract, and I wish to move back to the United States to be with my wife (we have flight documentation etc as proof that we have maintained our relationship). My question is, after all that, will I still be eligible to re-apply for permanent residency? Sorry for the long-winded post. I thought I should try and apply as much detail as possible to the situation. Any help or advice would be greatly appreciated.

    Your situation seems a bit complicated. I think you should consult an attorney to be on the safe side. Good Luck.

        On the bright side, your relationship with your wife has endured a lot of ups and downs and that ought to get you some leg room to stand on for the next steps. The advice to get a competent attny is a sound one. Good luck, mate.
