  • Question regarding I-864 for K-1 visa

    Hello,

My Fiance just received her appointment date from the embassy and, in the letter it lists all the documentation to bring to her interview.

One of the documents is a copy of my IRS transcripts and it mentions in the footnotes "of tax return prior to the signing of the i-864 affidavit of support form". While going through all the steps with USCIS/NVC etc., and following the directions on the state.gov website for K-1 visas, it never mentions having to submit the I-864, it simply states "Evidence of financial support (Form I-134, Affidavit of Support, may be requested)" which is a different affidavit of support.

The issue is that I-864 requires filing with USCIS at the chicago lockbox address, and me, being overseas there's no way it will reach USCIS before the interview. Additionally, to retrieve the IRS transcript the IRS requires a U.S. mobile # under my name which I don't have, so I had to mail the activation code to my address in the U.S. - Theres only a week until the interview.

Wondering if anyone else has had to file this one for the K-1 visa, can she just bring the I-864 with her to the interview or does it need to be processed by USCIS prior?

Any insight/advice is appreciated, I sent these questions to the embassy as well but after a few days have got nothing back.

No, I-864 is not applicable to K-1 visas. It's a typo; they probably mean the I-134.

This is my personal opinion and is not to be construed as legal advice.
