  • How to Apply for K3 after already filed I-30 and became citizen?

    Hello Everyone,
    I really need help and recommendations as I'm kind of confused how to do this. Here is my situation:
    I married my wife while I was still a green card holder and I filed I-30 under permanent resident status, I became a citizen couple months ago and now I can actually apply for her visa to bring her faster with K3 visa but my concern is I changed my last name when I became a citizen. So how should I file for her K3? Do I use my previous last name or do I use my new legal last name?
    And what should I send with my application? I will highly appreciate any help.

    K3 is obsolete. She will get the immigrant visa directly. If your I-130 has already been approved, notify NVC about your naturalization, and have them upgrade the petition to the Immediate Relative category.

      Thank you for the reply, I have already done that but the processing times on I-30 will still be the same. There will be no wait for visa availability. According to my understanding and what I have been told is I can apply for K3 Visa which is I-29F and my wife can get here on K3 visa and wait for her I-30 application. I like to know how to apply since my name is changed?

        Like I said, K3 has been obsolete for many years. You can file I-129F, but it will not get approved before the I-130, and when the I-130 is approved, the I-129F is cancelled, which means she will not get K3, and she will get the immigrant visa directly.

        You should always put your current legal name on any applications you file. You will attach a proof of legal name change to match it with your previous name.

          Do you know what address should I mail my upgrade request to?
