  • regarding spouse visa

    Hello everyone,,
i got married in usa in 2005. got separated and divorced from previous wife in 2009 but didn't complete that divorce in court and moved to pak in 2012 and got married in Pakistan again in 2012. didn't came back to us till 2015 and car paint thickness gauge found out that last divorce was not finalized in court and did that divorce final.. applied for my wife spouse visa after divorce decree but consular at pak embassy rejected the spouse visa on grounds of first marriage was valid while getting 2nd marriage.. now are the options i have? fiance visa? or something else? please advice?

The K-1 is probably not an option because despite that second "marriage" not being legal for the purposes of a CR-1 or IR-1 visa for your second "wife", the ceremony you went through with your second wife is enough of a "marriage" that she is not your fiancee. As soon as a consular officer or a CBP officer sees the photos of you two at a "wedding" ceremony, it's over.

So what you have to do is marry her "again". I gather that since Pakistan permits polygamy, you probably cannot legally marry her again in Pakistan because to Pakistan you are already legally married.

So you need marry her in a country that doesn't have polygamy and thus considers you two to be unmarried.
