  • Getting K 1 Fiance Visa after being charged in Canada

    hi , can anyone help me , one of my cousin has been charged in Canada for sexual Assault and he was a Temp Resident there and he left the Country without facing the trial and Finger prints . His Girl friend lives in US and she is a Citizen of United states , will it be a problem for him to get Fiance Visa and Green Card in United states because of his pending case in Canada . He got 10 years Multiple Visa for US too , I am just wondering will it appear in the US Border or Immigration Systems about the case ? and will it be a problem for him to apply for US Fiance Visa ?

    Please Provide honest and True Information .

        USA and Canada are very friendly with each other. I would be very surprised if the USA does not share some kind of database with Canada about things like that.
        My Fiancee arrived here on a K-1 VISA.
        Conditional GreenCard has been received.

          If they share but the person is not convicted then what is going to happen , he has already left the country ...I am sure US wont send that person to Canada for the trial though ... Every country have there own rule i think ..

            Yes, every country has its own rules and then there are agreements between countries to address serious matters as fleeing to avoid trail (I'd imagine one such between the US and Canada) - that in my layman's pov is as good as pleading guilty and thus the sticky situation.

            Not to state the obvious - Time to lawyer up.

              Thank you for your suggestion .. but Fleeing from the country because of life threat is better then rather staying there .. well US & Canada do share these things but only serious crimes , he has been accused not convicted .. its better to get an Attorney
