The beneficiary went to the interview last year November, the embassy officer rejected to issue him fiance visa and told him to wait for the letter from USCIS. It has been more than 3 month, we have not received the letter. I called the USCIS, the rep is not helpful at all, she basically just read our case status from USCIS website which indicates our case was approved at the USCIS office in the first step, when i explained again our situation she says the system dont have any updates.
When we found out the visa is rejected, we decided to get married and file for I-130 spouse visa petition. Now, what should I do with the fiance case? It is not completed closed yet, some people say there is not point to wait for that letter which takes 6 month, should proceed to file for spouse, just include a letter in the package to notify the officer we would like to withdraw the fiance case; some people say have to wait for the final decision letter otherwise will impact the spouse case.
Does anyone has similar experiences or knows what to do in this situation?
