    I know i have 90 days from the time she arrives but as for submitting my AOS...within the 90 days? or can i submit it on the say...the 86th day and have it arrive on the 91, even if the marriage cert is signed prior to the 90 day period? Trying to figure out our wedding plans. (gonna go to city hall and get the official stuff out of the way, then plan a bigger ceremony sometime this november).

    My family tends to do small courthouse weddings to get their bride/groom on benifets from work. Later they throw the big wedding party and have a priest perform a renewing of the vows (guests are told that it is a wedding and only a few relatives know about the previous courthouse wedding).

    I did not care about the court house wedding but I had my witnesses take lots of pictures incase they wanted to see them at the AOS interview.

    Maybe if you do that it will take off the pressure of waiting until the end of your 90 day window. Consult your clergy to make sure he will still perform a wedding ceremony, I have not heard of any clergy refusing but better to check before hand.

      Well, technically their main concern is "legal" marriage. Which means a marriage license or certificate. As far as submitting your AOS, it "should" be filed within, but will not affect anything if submitted later, as long as it is not toooo long. Remember that you still need to obtain social security, work permit etc. So the sooner the better.

        nice, i just called the marriage court and that is where i get my license. Would that suffice? or do i need to hold the ceremony and receive the certificate?

          License is not a marriage certificate

          So it would not be valid for filing with USCIS. It only shows your intent to marry, nothing more.

            bummer, i guess we'll go through a drive through since its what vegas is known for. Always wanted to be married by Elvis lol. So goign to the courthouse won't suffice for the AoS correct?

              Yes, if that is what it takes. I was married in Vegas for the simplicity. You can get the License and there are limos outside the courthouse touting for business to get you to their chapel. Rather surreal. But that is what it takes. Then you can have your dream wedding at a later date. Good Luck and bet on Black!

                Most judges in most states can perform a simple "marriage ceremony" for you if you have your license. You don't have to go to Vegas to get married. For that matter, you can generally walk into any church with a couple of witnesses and ask a pastor if they have a moment to spare to perform your ceremony. It takes all of 10 minutes if you go into a judge's office and they're not busy. Then they file the certificate with the court clerk and you get it back in the mail in about a week. You'd be married on paper and would have that to show to the USCIS for her AoS, and could have your wedding at a later date. That's what we're doing, just to get the ball rolling a little faster. We want to be married, and we also want to have a wedding, but we know that we can't book another venue till the visa is in hand without risking deposits. We also know that it's about 90 days till he can work from the time the I-765 is filed, so the sooner we file it, the better.

                  haha yea well i live in vegas so its a matter of driving 5 minutes to old downtown lol. Thanks for the input guys =) July 10th is the day we decided on to have small one. Probably later november of this year will we have a bigger one.

                    quick and potentially stupid question. I'm about to fill out the I485, but it also says i need a I130. Is this true? or is it just outdated? Reason i asked, so far no one has mentioned the I130 and i always assumed the I130 was a K3/4 visa ap not a K1.

                      You fill out I-485, I-131, and whatever the EAD form number is. Three applications and all the support paperwork to go with them.

                      The I-130 filed with the I-485 is for people already in the US who don't do the fiance/spouse visa process. They kinda do the petition (I-130) and AOS all in one go. Many adjust from student, work, or even visa waiver status because they are already in the US legally by some other means.
