new executive order (for immigration halt for 60 days) ban K-1 Fiance visa holders??

Hello all members.



As Iam K-1 Fiance visa holder was about to travel to USA but due to travel restrictions imposed by Pakistani government i could not able to travel USA.

after few weeks now USA government signed New executive order on immigration halt for 60 days.

my question is, does that new executive order ban K-1 fiance visa holders?

Am i eligible to travel to USA on K-1 fiance visa in these days?

please help as i could not understand clearly about executive order who are banned and who are not?

K1 is a nonimmigrant visa so you will be entering as a nonimmigrant, so you should not be affected (especially since people who already have immigrant visas are not affected by the proclamation, so it would make no sense that people who already have K1 visas are affected)

That's a fair question, and there are two things to note: First, the travel ban doesn't affect anyone who's already got an approved visa. So, right off the bat, you're exempt from this new EO under section 2. Secondly, the fiance visa is not explicitly called out in the new EO. But since the spousal visa is exempt for US citizen partners, it's fair to assume that K visas will be categorized into the same list. All in all, I think you'll be able to enter the US with your K visa assuming this covid-19 issue dies down soon enough and borders open up.

@ Pkumar01 thank you for reply... actually new EO have not banned K-1 visa holders OR cancelled K-1 visas but it restricted immigrants travel to USA upto 60 days. so i am worried that K-1 visa holders can travel to USA in these 60 days or not?
