  • Question Regarding K1 Visa

    Hey Everyone,
Just a question i was curious about.

    1. If i met a girl and i like her and decided to engage with her back in the country and then go back to the united state and start the K-1 Visa?
    2. What is the difference if i engage with her and start the paper for her back in the united state versus marriage in her country and do paper work?
(Is engage faster process for her to come then marry her and do paper work?)

    3. If i have a child with her when we engage does it help speeding up the process or help with the visa process?

    Hey,
    1. Yes, as long as you've met face to face within the last 2 years, you're eligible to file the I-129F (assuming, of course, you're otherwise eligible). You don't necessarily have to get a formal engagement. That's not absolutely required.

    2. The differences are extensive. There's a difference of speed (ie. fiance visas are generally much quicker than spousal). There's also a difference in cost, "complexity" of paperwork, and approval ratings. Which one you prefer is based on your priorities.

    3. No, having a child doesn't make anything happen faster. You will still be in the queue like everyone else. Your child, however, will need a CRBA if born abroad. There's details on that too, if you'd like me to explain.

    --Good luck--
Good luck. I learned the hard way, I hope you don't have to. Immigration is interesting. Not considered as legal advice.
