    My fiance arrived on April 13th, on the K-1 Visa. We were just married on June 11th and he is in the process of completing all his documentation to submit, for his adjustment of status. My question is that as his 90 days is about the expire for his arrival on the K-1 Visa and we DID get married on June 11th, but I am not sure if we should mail the marriage license someplace to verify that we DID get married.

    I was concerned that since he hasn't submitted his documentation for AOS that immigration would think that we weren't married and try to deport him or something. I know I might be worried over nothing - we can verify that we were, indeed, married on June 11th, but after getting married, we were preparing to honeymoon, buy our house, etc. that he is behind on submitting his AOS.

    Can anyone provide me with some reassurance that all is good?

    Normally a marriage license is signed by the officiant saying he performed the marriage. THEN it is mailed or taken in person to the courthouse or county clerk's office to be recorded in the marriage records of the county and state. Only then is it a marriage certificate. Each state will have different procedures, but that is pretty common in most states. I think you will need the marriage recorded and a certified copy will show something official from the county---it might be a stamp, a seal, or an embosser seal, and then a signature and date of recording the marriage in the official records. You can send a photocopy of that with AOS.

    You should be able to walk in to the office where you got the license and walk out with a certified copy of your marriage certificate, but that depends on the location.

    You are actually not required to file AOS within 90 days. You are only required to marry. There is nothing in the immigration laws that actually puts a time limit on filing AOS. BUT with that said, the sooner the better.

      Thanks for the information, Nichole. We obtained a copy of our marriage certificate from our local clerk's office one week after our wedding. I just wasn't sure if my husband had to file his AOS within the 90 day period and you just answered that for me. Thanks!!!

        in same realtion to this, after marriage i would send the AOS along with the doctors exam and a COPY of the marriage certificate? or the acutal certificate itself?
