  • Administrative Processing After Interview!!!

    Hello,

My fiance interviewed today at the U.S Embassy in Jerusalem. Evidentally, he failed to bring his original divorce document in the foreign language, but he had the translated document. They issued a letter stating that they can not issue him a visa under section 221g. They will need the original certificate in order to continue processing. They also gave him back his passport. I really don't have much information about the process. Does this mean, once he provides the divorce certificate, they will issue the visa. Or, does it just mean they need the document and then they will make a decision. Also, how long does this take? Any ideas or information would be greatly appreciated. Thank you in advance!!

It means that he didn't bring everything needed for them to make a decision. So if everything else seemed to go well at the interview, then when he provides the missing piece of the puzzle, they will approve and issue the visa.

I don't know a soul who has gone through the embassy in Jerusalem, so can't speculate on how long it will take. From other countries, it seems like it takes awhile for them to get back to your case. It's like you mail in the stuff, but they are so busy with the daily interviews, that they set aside those old cases until they get around to them. I have no idea if that's true, but it seems to those waiting that they stuck the files in a dusty corner. It probably won't be a quick turnaround---meaning it won't be like you mail the stuff on Monday, they get it Tuesday and open it up and approve the visa on the spot. It will probably take longer than you like for it to trickle through the system. But who knows, maybe Jerusalem isn't very busy and is super efficient.

Most places won't keep the passport unless they are going to issue the visa, put it in the passport and send it out within a day or two. But most people who don't bring everything needed for approval are told exactly how to get the missing docs back to the embassy and to send their passport with the missing document. Other times the embassies say they will call and tell the applicant when to send the passport. Often it has to go back by courier. Again, I don't have any relevant info on his consulate, but just a general idea of what I've read about other places. Each consulate will have their own unique procedures.

My wife (then Fiancee) was missing her original Police Certificate and translation. The translators had it finished but we did not have time to go get the document before the interview.

She was told that her VISA would be approved if her police certificate was clean like she said. We returned with the original and translation later that day and gave the documents to the security guard. One week later her passport arrived at her house with the VISA glued in it.

We used a different embassy but I thought what happened with my wife might interest you.
My Fiancee arrived here on a K-1 VISA.
      Conditional GreenCard has been received.
