  • Wife and Kids legal status help.

    I applied, for a visa for my wife and kids and 2 weeks ago i got a I-797 form saying that my application for my wife and kids were approved, but what do i do from here?

    They are in Brazil and I'm a U.S Citizen, the process shoulnd't take long according to the consulate but I'm not sure what i should do?

    she lives in Sao Paulo and anythign immigration wise has to be done in Rio De Janeiro, but i don't want to send her there with just those letters anyone have any assistance? or ideas they can provide i'd aprreciate it thanks!

    I would presume that your approved petition has gone to NVC and needs to be processed there first, will take a few weeks yet approx 4. Your letter should have stated what will happen next or if you do not hear anything within 4 weeks call the hotline.
    I am not sure if I am correct here but this is the normal procedure for all petitions. should not be that much longer for you.

      You are correct it went to the processing center near me, which is Portsmoth NH. But no the letter did not state what would happen next. I'll wait 2 more weeks and see what happens, seeing 2 already went by.

        Cool thought you would have heard something, New Hampshire is the NVC and ours went there too, It was there aprox 4 weeks and then my fiance received email with forms attached for my interview at my consulate in Sydney Australia, he forwarded it on to me and downloaded it and printed off what I needed and have to take with me.

          Well i have no idea I'm waiting 1 more week than I'm calling to find out, i never put an e-mail on the form i don't believe. My wife and kids are very antsy and so am i, did you have to do an interview?

          What kind of papers do they ask for? Medical records?

            Ummm I had email alert set up when it was being processed with USCIS but once it goes to NVC there is no more emails in that sense or updates.
            The letter we got saying that our petition had gone to NVC just stated that if we didn't hear anything within a month to call and we got an email exactly 4 days before the month was up. We are going through 129F but they would have got the email from the USCIS when I opened and status update with them.
            I have my interview on the 17th August and yes a medical is required and a police report as well. Your fiance can get all that done before you get notice of interview. As when you hear from NVC they will give you your case number, different from your recepit number. On the USCIS site or on your wifes consulate or embassy page it will tell you which doctors she can go to for this. In Australia had to go to local police station where living for the last year or so and they give a list of doctors to go to.
            Be patient as I have been stressed too waiting for all this but don't get antzy you will hear very soon I am sure of this. No point in upsetting anyone as could go against you. I know when we applied in march I had no idea it would take nearly 5 months for all this to happen but it's the system and we all have to wait unfortunatey. Take care you are nearly there.

              Here's an update my wife got the interview letter, for feb 9th how long till she can travel?

              Do they stamp the passport right away? Someone told me although she had an interview didn't mean she was accepted into the country? I was hoping of booking the plane tickets now but im afraid to book it and they ask for her to return for some odd reason?

                I don't know what RDJ does but many consulates keep the passports at the interview and return them to the immigrants by courier after they have put the visa inside. It sometimes takes a week. Mexico makes you wait a few days in Juarez to pick it up in person. Each country does it differently. It is also possible your wife may not have all the documents they require and they will hold the approval waiting on something else to be sent. Don't make travel plans until they all have their visas and passports in hand.

                  Well i spoke to my lawyer he says 2 of the forms they ask for in the paper, it was already sent to the U.S embassy in brazil, so i mailed her all the other forms needed and more so i hope thats all they will ask for.

                  My wife and i have been researching and the embassy down there says it takes 15 days to receive the passports, but i don't know how long it takes for the answer.
