A query about Fiance Visa

Hi,

My sister was on Student Visa here in USA with us.
She had to opt for a voluntary Departure to India following a prolonged out of status student in school. (about 3 semesters)

Now, after a year from that incidence, we are thinking about her Engagement/Wedding with a boy in USA. He is a US citizen.

Question is,
Will she be allowed to come to USA on Fiance Visa, as I remember the immigration judge telling us that "she may not return for three years."

Are there any provisions for her to return to USA before that?

Not very likely without spending money and returning to court and even that would take months and the outcome would be unknown. It would be far easier just to wait the three years.
