  • Can I claim assets on income for I-864

Hello, my name is Tran. I like to sponsor my Fiancee to US (Virginia state). She doesn't have any kid. I don't have any under 18 years old kid. I have a spousal support of $1,500 a month for my ex-wife.
I have a question about Affidavit of Support of I-864. My annual income is about $10,000. I own one house about $300,000 in value. I have 401K and stocks about $200,000.
Do you think I am qualified to sponsor my Fiancee to the US?
    Thanks.

For the K1 visa itself, it's I-134 you need. I-864 will only be needed when doing Adjustment of Status after marriage in the US.

This is my personal opinion and is not to be construed as legal advice.

When it does come to the I-864, assets can be counted in lieu of income if they are readily convertible to cash (your stocks and perhaps any equity in the house may), the 401-K likely can not. The value of these assets must be five times the amount you need to make up between your salary and the required income.
