    Hello,
    I have several different questions. My fiance and I applied for a I-129F visa last June 2009 and were denied the end of October 2009 because we did not have enough evidence. Now we have filed again this year with a lawyer. Our visa petition was received June 4th, 2010, and the receipt was issued on June 14th, 2010. My first question is, could the previous denial of a visa affect this present visa? Second, our receipt was issued on June 14th, 2010, but on the USCIS website when I check our case status it says our petition was received June 28, 2010. Is this a problem?

    Another question I have is, I have read on here that some people who filed their visa petition on June 1st, 2010 have already received their visa in hand by August 2010. Im just curious does the country where the fiance is from affect the visa?? If not, then why is there such a large gap in the times visas are being approved? Supposedly they are processed in the order they receive them? We have still not heard anything, and it is about to be 5 months for us, and Im just curious, where should we call once our visa is out of the approximate 5 months because the number the USCIS gives on the webpage is VERY unhelpful. My fiance is from Argentina. sorry so long. thanks for any help you can give me!

    To be honest who knows why it takes so long for some and not for others. Yes I beleive that certain countries go through quicker than others. I can only imagine what USCIS go through with certain countries so of course red flags would go up with them. As for your petition last year being denied and then this year it should not have any bearing on it as long as you have all the evidence this year. I am surprised they did not ask you last year for more evidence rather then just denying you. Is that the only reason? It says to wait 5 months before calling but I can't help you with the number like others you keep trying till you get through.

    Just a note if you are using a lawyer make sure he/she is reputable and sends all documents in with your paperwork. have read some horrifying stories on here and another site of lawyers destroying lives because of stupid mistakes made by them the lawyer and it just being a money making project. One would hope you had them checked out.

        thank you for your help! last year when we were denied i did little research and only sent the initial petition papers along with the check because I thought when they needed more evidence that is when they would ask for it, but obviously very wrong. we received the initial receipts and then four months later simply got a denial. you would think when they opened up the package they would instantly see that there was nothing there and either deny me outright, or like you said ask for more evidence. to me it is very unfair and extremely frustrating.

        as far as our current visa, we sent a ton of evidence, and yes, our lawyer is reputable. she said she has never had a fiance visa denied, so were are hoping this time everything is ok. thank you for your concern.

          Good on you well good luck then and yeah your right if there was not enough evidence last year you would think they would have RFE'd you straight away but oh to the wisdom of USCIS my friend.
