  • Quick Questions...

Yes, it is for the K-1 application.

My dad has agreed to sponser him. Who will need to fill out the I-864 form?

You can print out the form.

To bring someone to the U.S., you have to qualify to submit an affidavit of support, I-864. Read up on that.

      And...

With neither me, nor my Fiancee not having a job, will it be more difficult for our application to be accepted?
Is this for a K1 application? Print them out from the net and if you both don't have income as it is important for the petitioner to have income to support the beneficiary then yes it will be harder you have to fill in I-134 affadavit of support and you would need co sponsors to help you

Affidavit of Support I-134 for the K1 visa
You fill out as sponsor even with zero income.
Dad fills out another one as joint sponsor. His income must meet the requirements for his entire household plus one (the immigrant)

Affidavit of Support I-864 for the green card once you marry

Dad fills out another one as joint sponsor ff he lives at a different address from you.
If you live in the same house with Dad, then you can put his income on your form as a household member and he would do an I-864A.

Has Dad also agreed to pay all the costs? There are more fees than filing the fiance petition.
          Medical exam abroad
          Police certificate
          Visa fee
Transportation to the medical exam and the consulate. Could be a plane ride to get to the consulate city or overnight stay in hotel.
          Courier fee
          Moving costs
          Marriage License
          Adjustment of status fee
          Immunizations
Civil Surgeon fee to fill out the I-693

Small things add up. We spent over $4000 doing it ourselves without a lawyer.
