My stepson's I-485/I-765 application has been rejected twice. I sent a copy of his mother's I-130 approval notice each time. Does he also need an I-130 approval notice. He does not have one in his name.
They (mother and child) have been in the US for almost two years on K-3/K-4 visas. I thought he would have derivative status. If (probablyl when) they reject the application a third time, will I need to include an I-130 application along with the I-485/I-765?
