  • K3/K4 visa and I-130 processing times

Hey all! I'm wondering what your experiences have been with the I-130 in terms of a timeline. I spoke with a lawyer the other day and she said it's kind of a gamble as to which processing center our application would be sent- some indicate a 5-7 month waiting period for the USCIS portion. Others note it's taking 17-22 months. Quite a difference! Has anyone, facing long wait times, gone the K3/K4 route? Is the time line any different for minor children as compared to a spouse https://routerlogin.uno/https://192168ll.link/ ?

    Thanks!

    Timeline for I-130 Petitions

The processing time for Form I-130, Petition for Alien Relative, can vary depending on the processing center and the type of relative being petitioned for. According to the USCIS website, the current processing times for I-130 petitions are as follows:
    • U.S. citizen filing for a spouse, parent, or child under 21: 13.5-15.5 months
    • Permanent resident filing for a spouse or child under 21: 26-36 months

However, it is important to note that these are just estimates. Some cases may be processed faster or slower than others.

    Processing Center Differences

Your lawyer is correct that the processing time for I-130 petitions can vary depending on the processing center. The following table shows the current processing times for I-130 petitions at each USCIS service center:

    | Processing Center | Processing Time (Months) | |---|---|---| | California Service Center (CSC) | 5-7 months | | Nebraska Service Center (NSC) | 17-22 months | | Texas Service Center (TSC) | 13-15 months |

    K3/K4 Petitions

If you are facing a long wait time for your I-130 petition to be processed, you may want to consider filing a K3/K4 petition. The K3 visa is a nonimmigrant visa for spouses of U.S. citizens. The K4 visa is a nonimmigrant visa for children under the age of 21 who are the unmarried children of a U.S. citizen or lawful permanent resident and their spouse.

K3 and K4 visas are processed much faster than I-130 petitions. The current processing time for K3 visas is 4-6 months, and the current processing time for K4 visas is 6-8 months.

    Timeline for Children

The timeline for I-130 petitions for minor children is generally the same as the timeline for I-130 petitions for spouses. However, there are some cases where the timeline may be shorter for children. For example, if a child is being adopted by a U.S. citizen, the I-130 petition may be processed more quickly.

    Overall

If you are facing a long wait time for your I-130 petition to be processed, you may want to consider filing a K3/K4 petition or speaking with an immigration attorney to discuss your options.

I hope this information is helpful.

Hello! Experience with I-130 processing times can vary widely. The timeline depends on factors such as USCIS service center, caseload, and individual circumstances. While some may go through the process faster, others may have to wait longer.

Choosing the K3/K4 route may be something to consider, especially if you are facing long waiting times. However, it is essential to consult with an immigration professional to determine the best course of action for your specific situation.

For minor children, the processing time for their application may be different from the processing time for their spouse's application. It's like conquering merge fruit for children and adults. You should check USCIS processing times for specific categories (e.g., IR-2 for children of US citizens) to get a more accurate estimate.
