    Hello. I had a question about the Affidavit of support, and hope someone could help me. It is stated that the income of the intending immigrant can be used if the same source will still be used after immigration.

    My wife is employed in Taiwan, and I plan to use her income for the Affidavit. I am currently a student, so do not have sufficient income. I wonder if her income would be accepted?

    We have a letter from her company stating the employment will continue even after immigration. I am not sure if I should include a copy of her Taxes from Taiwan?

    The form asks for my most recent tax form, however I filed as a student, with no income, so not sur if I should send that in anyways, or not.

    Sorry for all these questions, but I really do not want to pay an attorney jsut to have some few questions answered. Thanks.

    So are you filling in an I-864 for a CR1 visa? I'm more familiar with the K1 process, but I think the letter from her employer stating the nature of her work and how it can continue in the US would be a good start as well as her current yearly salary in US$ equivalent. Her taxes could be additional proof if they show yearly income. How that will be treated or accepted, I don't know. Sometimes that decision is subjective. If they don't like it, then they'll tell you to come back with a co-sponsor. A few extra hoops for you to jump through.

    For you: if you filed a return you must send a copy even with zero income. If you didn't file, you sign a statement saying "I was not required to file a 2009 tax return because I earned zero income [or the exact amount if you had even a tiny bit of income]."
