  • Approved 5 months ago at interview, still in AP

    Greetings!

My fiancee, a Canadian Citizen, was told by the agent doing the interview the K-1 visa would be issued (he didn't mention anything about AP), this was 5 months ago, and when we try to check the status they just tell us its in administrative processing and to not contact them, the will contact us if they need anything.

She was born in Cuba and last visited there 5 years ago, which is the reason for AP.

    No arrests, terror ties, etc.

How long should we expect this to take ( I know there is no limit )? If there any usual time limit though when nothing negative other than the country you were born in (it seems like they consider that a crime) can show up?

Does AP for a K-1 visa take any shorter or longer than for other types of visas?

If we do not hear anything from them in the next couple months or so, are there any other options?

    Thanks,
    Frank

You can contact your US Congressman's office. Many have an aide who assists with immigration problems. When a congressman inquires on your behalf about the unusually long delay, they must reply to him within something like 3 days. They may only reply that it is still in security checks, but sometimes it shakes the application loose, so worth a try.

There is a form you will have to sign giving your permission to release your private information to the Congressman's office.

Thanks, unfortunately I have tried that, and got only that it was still in administrative checks like you mentioned, they didn't seem inclined to ask for any other details, or offer further assistance to me. It seems like its just some guy reading off a screen and was unlikely to shake it loose as well.

Any idea how long these typically take? I know there is no limit, and some people are harder to look into than others, but this case with my fiancee is pretty open and shut, no arrests, no travel to Muslim countries, uncommon name, etc.
