  • Fiance has 2 yr HRR

Hello. My fiance was on a J1 visa in 2008 and was subjected to a 2yr HRR. His 2 years will be done in September of this year (09/11) and I'm just wondering if I can file for a Fiance petition (I-129F) now since its only 7 months away from fulfilling his 2 yr requirement. Another question is he was given an SS number when he was working as an intern here in the US, does he have to write it on his G-325A regardless of it being valid only when he was here? Hopefully someone can help me with this. Thank you so much.

Read the guides here for 129f petition and once he has a SSN that's his for life and yes he can put that on the form G325. While he is here you can start to get together your 129f petition as its great he can help you with all the documents you need and can sign 325 while he is with you, you don't have to wait for mail or email. Then when his J1 visa is up he can go home to his country and you will wait for approval and he has his interview in home country and then he comes back and you can get married in the 90 days from arrival.
