I am 20 years old and a U.S citizen. My fiancé is 16 turning 17 this June and her parents are going to sign the papers so we can marry. The problem is that she entered the u.s illegally when she was 8. We have decided to go back to her home country which is brazil since there is no way she can fix her status here in the U.S. I spoke to a couple of attorneys and they told me that until someone turns 18 1/2 they do not start accruing unlawful time so as long as we returned to brazil before her 18 th birthday she would be able to get an immigrant visa. I read this memo you guys posted up and you guys say that it isnt recommended leaving the u.s even for children if they have been here more than 6 months so I would truly appreciate your opinion on my case and any extra information you guys could help me with.
