  • I-864 and recent job change. Qualify?

Before, i was working as a waiter. I claimed my tips but I dont think USCIS would have accepted the base + tips method. I recently obtained a job that is salary plus commision. I make 24,000 a year base, so 2000 a month. benefits are taken out of my check so that brings it down to 20,000 a year in check stubs. I've only had 2 check stubs. It is just the two of us at this point.

I've already been told I need to find a co-sponsor or provide proof of income. Will a statement from my new job work? If I send it in, will they deny me or allow me to then provide co-sponsor information?

You qualify, but you must clearly prove you make $24,000/year. A letter from your employer on official letterhead stating your position, salary, number of hours worked, and whether it's a permanent position will be good evidence. (Permanent position in this case means it's not a two-month contract or a seasonal job but will continue.) Your pay stubs should show on them somewhere your salary before deductions and are good proof. Send photocopies of those.

If the USCIS has a problem with that, they will notify you with a request for evidence letter giving you a certain number of days to send in what they ask for. They could be asking for just a tax return, or for you to sign your form, or for a joint sponsor. It can be anything they think you forgot or need for approval. Your case is on hold until you respond. If you don't reply to them by the deadline they give you, then they could deny you for lack of enough evidence to approve you.
