  • Please help!

    I recently got married to my wife who is an american citizen. I came to the united states on my tourist visa and married her before my expiration date.

    We both went to an immigration attorney who has told us we need to collect several documents in order to get our file processed for my working permit.

    However including that we need a co sponsor because my wife doesn't qualify to be my sponsor. Now our sponsor has backed out and we have no other co-sponsor and we are already married!

    What happens from here on out? Do we get a divorce or is there a way to continue our marriage as we love each other very much and under no circumstances do we want a divorce.

    PLEASE HELP?

    To live in the US legally, you will need a greencard. She will have to meet the minimum support level or get a co-sponsor--no way around that.

    Marrying on a tourist visa is sometimes a slippery slope anyway. It's is for tourists, not an immigrant visa, so you have to do it just right.

    An option is to return to your country before your over-stay is long enough to get you deported or banned from the US. Then she can file an I-130 spouse petition to start the process of getting you a CR1 immigrant visa to come back. She will need enough money or a co-sponsor still, but can work on finding someone while you are not building up overstay days in the US and risking removal proceedings.

    If you have already over-stayed by more than 180 days, then you need to go to a good immigration attorney for advice on how to proceed and not go by opinions on a forum.
