  • Leaving the country before AOS

From everything I've read you're pretty much tied (unless you have an advance parole authorization) once you file for your AOS.

But is it possible to leave the USA after your wedding but before the AOS? I haven't read anything about this window. My fiance has a 10-year visitor visa, so even though the K-1 would be invalid would she be permitted re-entry on her visitor visa and then apply for the AOS?

Your advice and experiences is appreciated!

AHh once you are married beneficiary is out of status until AOS is approved. If you leave the country with out AP or GC you will be denied re entry. The visitor visa is invalid as beneficiary came in on K1 visa.

You can't come back on a visitor visa. I think it may get stamped void when the K1 visa is put in the passport at the embassy.

Your steps after entry on a K1:

      Marry
      File for AOS, EAD, AP
Receive AP in about 60 days. It processes faster than the greencard normally.
      Travel

The sooner you file, the sooner you travel. Prepare as much of the paperwork in advance of her entry as you can. We had AP about 70 days after my fiance's entry on a K1 because we married the 5th day and filed the 8th day. It's possible with careful planning in advance.

If you wait until she arrives, then post "how do I get a marriage license?" And later post "what do I do now?", then you are delaying yourself for not researching those things earlier.
