    Hello All,

    I have read the dangers of entering the US on a tourist with intent to marry and then applying for an AOS. But what if she marries and leaves? Does anyone know or have any experience with this scenario?

    1) entering the US on a tourist visa
    2) getting married in court
    3) leaving before the tourist visa expires
    4) applying for a K-3/CR-1

    Is this a viable option or would my spouse's case still hold a high probability of getting rejected due to misrepresentation?

    Well coming to the US with the intention of marrying is immigration fraud straight up ok. But it has happened and the legal way to do it is then yes your wife goes back to home country and then you file CR1 spousal visa for her which takes the same time roughly as a K1 visa application 5-9 months.

      Not exactly...

      From what I'm reading and researching getting married is not the issue. The issue is getting married with intent to immigrate. According to your statement any foreigner who wants to have a destination wedding in the US has to apply for a K-1? No. If your honest with the CBP at POE and don't overstay your visa one should be fine.
