    Hey guys,



    I'm fairly new here, I say fairly as I've been trawling the place for a few weeks behind the scene, mwhaha! Sorry!

    Basically I’m from Guernsey, Channel Islands, and no I won't be offended if none of you have heard of it before. In lament terms it's a tiny speck of an island off the south coast of England. I am, a British Citizen. And as the title line suggests, I have proposed and are planning to marry a great girl from Colorado, we will be residing there once the deed is done. But enough about me, I of course, as many others have some questions regarding the process;

    1. Do I need a police check? If so, is a Guernsey one going to be sufficient? I'm not sure if I could even get a UK check as we have our own government here

    2. My fiancé is worried about the affidavit of support. Seeing as we're taking the K-1 route my research is telling me that we need a I-134. Firstly, is this correct and secondly she is currently unemployed (we've just come back from a 3month road trip around Europe) and is currently seeking temp work. Will this reflect badly on the visa? She has a large sum of money in savings as her father passed away and left everything to her.

    3. We've compiled a list of things we need to get together in order to process the K-1. My list includes (Passport photo/s, G-325A form, relationship evidence, copy birth certificate, copy passport, copy right to work, letter of intent to marry, police check?) her list includes (Print K-1 & sign, relationship evidence, passport photo/s, copy adoption documents, copy both birth certificate, letter of intent to marry, fill out I-134 ) Does this seem to cover everything? it seems a lot but we would rather have too much then too little!



    Any help would be greatly appreciated!

    The 134 does not come into play till interview stage with you. All the forms she has are correct and you will both need a letter of intent signed by both of you to send in with 129f petition. You will need some pics too approx 8 proving that you have met in the last 2 years. Your police report all comes later after you have been approved 129f petition. You need to get that out of the way first. They should accept your police report and you will have your interview in London if I am not mistaken.

      Yes, unfortunatly I will have to catch a flight to Gatwick for my interview/medical! As if getting a visa isn't stressful/expensive enough!

      So do we just file the I-134 or do we need to eventually do the I-864 also?

        The ACPO police certificate (Google it) will cover Guernsey. If you have any crimes and also need a subjuect access report you will have to get that from Guernsey.

        Look up the I-864P (found under Forms on USCIS website) to find the latest poverty guidelines. As long as she can prove her income meets 125% of the poverty guidelines for her family size (you and her?) of 2 people, then all is well for the I-134 and the I-864 after you marry. It's roughly $18,000 for 2 people. To use assets to qualify, she needs 3 x $18,000 in the bank.

        I don't think you covered everything so go to the visa tab on this website and reasearch the guides for K1 fiance (way down at the bottom). They've written it all out so no point in me typing a long list. You're missing a few pieces and have some extras that don't go until later when YOU apply for the visa in London. No clue what you "copy right to work" is for.

        Keep in mind the USCIS requirements are free to marry, intend to marry in 90 days after entry, have met in person. Don't bog them down with how much in love you are or how many times you IM or phone each other. Document your meetings with passport stamps or boarding passes to each other's country; credit card or ATM receipts showing charges in each other's cities or both in the same city/same day...things like that. Photos together are secondary evidence because of no hard dates to prove the two year thing.

        Here's the list of YOUR documents (except I-134 is hers) you will take to the embassy in London when you interview:

        Birth Certificate (version with parent's names on it)
        Adoption Certificate
        Passport (with at least 8 months of validity left beyond visa date)
        Marriage Certificate
        Termination of Prior Marriages
        Military Records
        Affidavit of Support (I-134 and two good proofs of income)
        Police Certificates
        Court and Prison Records
        Photographs (2 passport style)
        Translations (of anything not in English)

          Just to clarify;

          1. Does the I-134 get sent to the US consulate with the I-129? Or does my fiancé just send it to me with the package?

          2. In your list of documents you've stated 'Marriage Certificate', I take this to mean from any previous marriages? As we have to get the visa first before we wed?

            Yeah, I know the London part of your process quite well. London is very easy.

            The petition is I-129F and it is not sent to a US consulate by your fiance if that is what you are asking. Your fiance sends the I-134 to you with proofs of income so you can take it in hand to your interview in London. You won't need it for several months so she doesn't need to work on it yet.
            "with the package?"....no clue what package you mean that she will be sending you other than the Affidavit of Support.

            That is a list for every interview/visa in London. Some people are married and are getting a spouse visa. Pick what applies to you. Obviously if you are a fiance, never been adopted, in the military, or in prison then some of those documents won't apply to you. Other than the listed items you will show up in London with your appointment letter and a receipt showing you paid for your visa...nothing more. No additional proofs of your relationship. No new letter of intention to marry. That is covered in the initial I-129F to USCIS and London does not want those at the interview.

                Fantastic, that's all I needed to know really. The 'package' is just my lazy way of saying 'all the stuff my fiance will send me for my interview'.

                  Hambim--I don't think he's going to find a lot about Guernsey police certificates by searching Immihelp. It's pretty limited. And London changes constantly so an old post could be out of date information. And because each consulate differs, information found about Sydney, Manila, Chennai, etc could be totally wrong for a London interview.
