Is it possible to skip K1 visa meeting requirment?

  • Is it possible to skip K1 visa meeting requirment?

    I was wondering if having my fiance denied entry to the UK is enough evidence to show that us meeting is not possible. As in, the detainment of my fiance was so traumatic and stressful for the both of us, we fear that if it happened again while we try to meet in person, it would destroy us emotionally.

    We're both very paranoid now about not being allowed to see each other. Do you think the immigration people in the US will think this an acceptable reason for skipping this particular K1 visa requirement?

    I see the following as an extreme hardship:
    If you lived in a country where you needed a full visa to enter the US and they are next to impossible to get, but you tried and were denied.
    AND your American fiance is disabled and can't walk, breathe on her own, and needs 24 hour nursing care so travelling overseas is impossible.

    I personally think it's weak. You live in a VWP country. Visiting is easy. Or meet up in Canada, Mexico, Amsterdam. As an outsider (like the people who will evaluate her petition, your visa application in London, and the greencard application after marriage,) I would question your intentions every step of the way. Yes, there are many hurdles in the process, not just the I-129F form.

    I would suspect why anyone would think about marrying someone they had never met or touched. You have not mentioned any deep cultural /religious reasons why it is a standard practice not to lay eyes on each other. I would wonder why she only bought a one-way ticket to see you and didn't have any money. I would wonder what it was that got her detained when millions enter the UK without problems. You do know she has to fill out an Affidavit of Support (twice) to show she meets income requirements?

    You can try it and if they don't like it and deny the petition you start over and pay again. It's possible but I think it might raise red flags and hang up your various applications at each step of the process. Just a personal opinion.
