    Hello, so i have a very complicated case... I just returned from Europe about a month ago where I met my now fiance. He is from Morocco but is a legal resident in Italy. The plan was for me to find a job and request to bring him over on a fiance visa... things just got more complicated... I just found out I'm pregnant. I haven't had a chance to file for the K-1 visa yet because I just found a job, which i will start next week. My question is... is there any way he will be here before the baby is born in February? It is extremely important to him, more than me, that we marry before the baby is born. There is a possibility that I could fly to Italy and marry him, but I have heard that this will only complicate matters more... is that true? I can't exactly wait until the last minute to see if this application is approved because I can't fly overseas when i'm 8 or 9 months pregnant... so I have no idea what to do! Any help would be great... does anyone have any idea how long the process takes??? Also, because he is a Moroccan citizen but is a legal resident of Italy (he's been living there for 6 years) does he have to return to Morocco to process this? or can he do it in Italy?

    The entire K1 visa procedure is supposed to take 6 to 8 months in average so considering the time limit it would be tight. In reality though, it can take even longer. Getting married in Italy wouldn't necessarily make things more complicated -- it would just mean that you have to file a petition for your spouse (I-130) instead of your fiancé (I-129F) and he has to apply for a CR1 visa instead of a K1. I'm not entirely sure about the processing time for an I-130 petition, but it seems like it's about as fast as the I-129F.

      His interview for either visa will be in Naples, Italy. In all honesty, I seriously doubt he will be in the US before the birth. It's because you will need some time to prepare your paperwork before you can send anything off. He's got to provide things to you by mail that he has signed. It takes some time to prepare a good application and a poor application will delay you even further. You will need to show you can support him at $125% of the poverty level as shown on form I-864P (2011 edition) and right now you are unemployed. Research the processes for K1 and CR1.
