    Hey Guys,



    I've got a real easy question for you.

    My fiancé and I have just sent in our I-129F and are both sitting here patiently waiting with all appendages crossed. However, she would like to travel from her home (Colorado) to my place (UK) and spend Christmas with myself and my family. After this, I would like to travel back with her to the states and spend New Year’s Eve with her family/friends.

    Is this possible once we have filed for the visa and have not yet got the OK for the marriage to go ahead? I would understand if it looks slightly sketchy but if we explained the circumstances in our relevant interviews I wouldn't see a problem with it.


    Does anyone have experience with this?

    As you have just sent off for the 129f petition you may not be approved till at least Jan 2012. And that's just the petition. Then you have to wait for petition to go to NVC for case number then on to London. SO unless some miracle happens and you are approved in 2 months say October then I would not worry too much about all this. Yes your fiancee can come visit you in UK for sure and as far as you coming to the US for NY as long as you show plenty of proof of residence and ties in UK as in your job living address you you will have no problem visiting US for NY. But I would not stay too long as your petition hopefully would be approved shortly after.

      Just another quickie though. Once my fiance and I are married, do I then have to wait for the AOS to be accepted before I can legally work in the states?

        Once you file AOS after marriage you will file I-485 along with I-765(EAD) work authority and I-131 (AP) advanced parole. When you file these 2 the fee is waived when sending in with AOS. SO fee is $1070 for the lot. You will receive a letter to have Bio metrics done and then after that you will receive your EAD and AP card as they are combined now in one card. Last year I got EAD card and AP papers lol so it is more stream lined now. Once you have that you can work. Takes approx 2-3 months to get that card and approx 4-6 months for GC but I got my GC right on 4 months of sending in AOS. Good luck ok
