  • Husband in Jordan

Hi, I went to Amman, Jordan December 2009 to live with my friends and to look into starting a new business for myself. While I was there, I met a man, fell in love, and married him during the year. We were married on December 9, 2010, but I had to leave Jordan suddenly because my mother in USA became gravely ill. Now I want to bring my husband, a Jordanian here to the USA to live with me. Can someone help me with this process?

I spoke with the local Immigration Clinic in Raleigh, North Carolina, but they referred me to lawyers. I do not have a great deal of money to pay lawyers for this help at this time. I do know this is a costly process.

One problem I face is that I only have 3 pictures of my husband and I together. We did not have a big wedding party, but we had some pics taken with my cell phone, but it was dropped off a balcony by a child in Amman, Jordan and all my pics were lost except for the 3 my husband had on his cell phone. I have heard the Embassy in Jordan will require 8 photos of us together, but I only have the 3 pics.

I have a copy of our marriage contract and it has been translated from Arabic to English. I also have a copy of his birth certificate, Jordanian driver license and passport, and all have been translated to English. I have all the other items as necessary, passport pics (current of just 2 days for him and me.)

I also have shared finances with him for the past few months, so we have wired each other money for assistance as a wife and husband should.

I am getting his name added to the deed of my home this Tuesday.

I feel all these things should show proof of our relationship/marriage. I am just concerned about not having enough Marital wedding pictures to satisfy the U.S. Embassy in Jordan.

Can anyone help me with this process and give me some advice? Would it be better to just bring him here on a Fiance Visa and just pretend we never married overseas? I don't really feel comfortable with that as we are legally married.

Thanks for any advice or help!

No you can't use a K1 fiance visa to bring him here you are MARRIED. You will have to apply for a CR1 visa spousal visa. You seem to have enough proof of marriage but if you get to see him sometime maybe you could get some ore pictures for his interview time.

Thank you for your reply, Yes, I plan to file for CR1/IR1 visa for my husband. But really, when you marry in foreign country I have been told the U.S. Government does not always view the marriage documents as being legal, for whatever reason. So I do worry about the marriage contract since it is originally in Arabic and had to be translated.

But the K-3 visa process seems to be more for Fiance' or Fiancee than for spouse. I feel better to file for the CR1/IR1 but still I know it will be a lengthy process, either way.

Thanks again for your help. I am most certainly appreciative of anything people might want to add here.

K3 is not for fiance at all and it is pretty non existent now so CR1 is the way to go and we all have had to go through the process of waiting. K1 is fiance visa. And married is married in the US no matter where you get married.

          More questions

I need to know how many copies of each item I send with my I-130 form for processing. Do I send 2 copies of each item or do I send 3 copies of each item?

Also, do I include letter to Consulate in the package for filing the I-130, or does this need to be sent directly to the Consulate of Jordan?

I am confused about this process. Do I write a letter to the USCIS with my I-130 package similar to the consulate letter?

Thank you for your time and consideration.

You need to thoroughly read the guides for 130 as I did 129 f not sure what you mean by how many copies? A copy of whatever they ask for. I suggest you do some reading of the guides here on Immihelp.
