    I need some help on K1/spouse visa and what is the best way?


    I'm a US Citizen, graduated from college this year and looking for jobs with hard luck.
    I am getting married to my fiancé in India soon. I am planning to come back soon after a month or so and find job and then bring my hubby after I am settled with a job.

    The major problem is that I am scared to apply and go ahead with this process because of the financial status (affidavit of support).

    I am unemployed but can I still show my assets or my bank account. How much I am supposed to have? Or can my fiancé show his bank statements or so?

    I also know that my parents can co-sponsor, but I am not sure if the family income is supposed to be higher than what it is now.
    Our family consists of four people, I am claimed as independent and my sibling is dependent still in college, my father has no income but shows previous company assets and my mother works part time.


    Many suggested that I should go with applying for fiancé visa and not with spouse visa.

    If in case, I want to apply for spouse visa while living in India until he gets his visa. Is it possible for my parents to co-sponsor so that me and my hubby can come together?

    Also, once i start the petition ..How long will it take from this month?

    I am confused with this whole situation. Hope someone can help me.

    Well for starters a fiance visa is for fiance only not spouses. If you wanted to petition for him with a fiance vise you would send in a 129f now . You wait for it to be approved then when it gets to his interview stage you fill in affidavit of support I-134 and yes you can use your parents as co sponsors. But you say you are going to India to marry him so then you will marry come back to the USA and file CR1 spousal visa again can use your parents as co sponsors and then you wait for it to be approved and then he has interview in India enters the USA and is able to work straight away also with CR1 and gets GC also on entry. You also have to find somewhere to live here in the US and prove that to USCIS so am not sure how long you plan on staying in India. You would have to come home and get that all sorted before he arrived and be working as well. It is not a definite time but takes around 6-12 months could be less. YOu need to do a lot of reading on CR1 or 129f fiance petition but as you are planning on going there and marrying you need to do CR1. You can look up the poverty guidelines for 4 people household. All the information you need is on here, You have some research to do.

      I appreciate your help and thanks a lot for the information you provided..I've couple more questions..
      I'm getting married in November 2011 in India and planning to come back to us after 1/2 months to apply for CR1. I also understand that it takes same amount of time (6months)regardless of when i apply.

      So, if i want to apply for CR1 after coming back in january 2012 When should i start the process? filing the I130 form & all that... {Is there a way I can start the petition this month? just want to know, guess this is out of context.}

      Also just curious about this another process, how about applying for CR1 in India itself and i heard it will take 3 months to get GC??,,,,because I don't want to be away from my hubby after the marriage.

      Please help me with my query..

        Your answer in in NINO1 post. You can't start the CR1 till after you are married and yes you can start it in India before you come home. Don't know where you heard it takes 3 months that is not true at all. Read what Nicole wrote on Nino1 post.

          I think she's talking about DCF in India (Direct Consular Filing.) You would have to check the requirements. It's normally for residents of India so find out what it takes for you to gain residency. Some countries require you to be a resident for 6 months before you can apply. There's three consulates also, so figure out from their website maybe if they even allow DCF. I only know London.
