I just recieved my approved petition from uscis a month early ( 4 month total) vsc
I was so nervous opening that letter a's it was totally unexpected. Anyways, my question is soon she will have her interview. There is a question where it asks if she has ever been arrested. She overstayed her visa 9 years ago in Cyprus and had to go back to her home country. The police did come to her house and took her to the airport without any criminal charges or seeing a judge. Once again she has 3 police certificates from 3 different countries including that one and her home country. Clean record except the over stay.
On the ds-230 it asks if she's been arrested? My heart is telling me to have her answer yes and just explain. Even in the us if she overstayed she could come back after 5 years, it was not the USA that she overstayed.
This is my last tiny worry that they could ask for documentation on her overstay, if your not a Cypriot it's impossible to get documentation. Anyways the main question...
Should she mark yes and explain or mark no because it's kinda in the grey area??
