  • Processing times versus approval

    Hi there,
I filed I-130 and I-129F for my wife residing overseas few months ago.
    I-130 receipt date is 6/27/2011
Using the receipt notice for I-130 I filed for I-129F.
    I-129F receipt date is 7/15/2011
I see that processing time for both petitions is 5 months for California Service Center. i have following questions...
1.Will both petitions get approved simultaneously around Dec 2011?
2.Does K3 spouse visa process gets shut down if I-130 gets approved along with 129F?
3.If I-130 wins will my wife receive forms for next steps? How long would it take for completion from that point?
4.If I-129F wins how long does it take from that point?
Please help. Thanks for your time. Have a great day

California SC is approving some mid-May I-130 petitions right now to give you an idea. Yours could be mid October if you don't get held up because they send a request for more information.

K3 visas are pretty much a thing of the past so plan on the IR1 visa. I-130s used to take a long time so they created the K3. Now they go as fast so they will shut down your I-129 most likely.

After approval your case will do a lot of processing at the National Visa Center. Both of you will submit things there. Look for guidelines on this website for an IR1/CR1 visa.

Once NVC is done, the case will go to her embassy where she will interview after completing a medical exam. Each embassy is a little different and it depends on the country. Some embassys are faster than others.

IR1 visa is a better deal. She will already be approved for a greencard before she gets here. She will be eligible to work immediately. Not so with a K3. You have to file for Adjustment of Status (another $1070) and wait months for the greencard.

OOps. I see I said IR1 visa. If you haven't been married two years, you get the conditional CR1 visa. Same process, but you only get a 2-yr greencard, then have to remove conditions on it within the 90 days before it expires. Then you will be issued a 10-yr card.

Most likely my wife would follow CR1 process from India. If i-130 gets approved in November i will receive the approval notice. right? After few days my wife in India will receive PACKET 3 for filling out more forms and fees for consular processing. Am i correct? Please help

Incorrect. You are describing the K3 process. Read what I said above about the National Visa Center process. You will both do certain things there and pay fees there. This website does not have a CR1/IR1 guide that I can find. You need to find another website like Visa Journey with good information to guide you through it.
