  • Fiance is filipina, but is in Canada on Work visa

    Greetings,
I wish to know if what is mentioned in the title poses an issue. Also, we will be dealing with the nearest US embassy in Canada, correct? Not the Phillipines?

Also, I have a birth certificate issue. My birth certificate says my mother was born in the wrong state. I used this Birth cert to get my passport, wich is required for k1. Any suggestions?

    Please and Thank You
    Bryan

She will be applying and interviewing in Canada. There's Montreal and Vancouver, so whichever is closest.

The main purpose of your birth certificate for USCIS is proof that you are a US citizen. Non-citizens can not file for a fiance. It doesn't really matter where your mother was born as long as you prove you were born in the US, thus making you a citizen by birth.

In the form g-325a they ask for biographical information which includes my mother and fathers birth information which is where this would come into play. Would your answer still be the same?

Also, am i right in thinking this may be a 6 or 7 month process?

      Thank you for your reply

I would put on the form exactly what's on your birth certificate then (about her birth state).

Minimum 6-7 months I'd say. Montreal is taking over 3 months for their part after the petition is approved, has cleared NVC, and arrived at the Embassy. Vancouver around 50 days, but that changes regularly.
