K-1 visa ?DO you need a lawyer to file a petition?

  • K-1 visa ?DO you need a lawyer to file a petition?

    I know we can print all the related forms from website we need but do you all think ''To avoid the unnecessary delay or making any mistake to file any type of visa petition??
    I need to file the K-1 for my fiance.
    We have a local office who are not a lawyer or law firm but they professionally do all the paper work.I have heard not hiring a lawyer can make some delay and mistakes?
    Is there anyone out there who prepare their all papers without hiring lawyer and had no problems.
    PLEASE advice me because lawyer is expensive?
    BTW how much lawyer usually charge for a K-1 petition and work till end??
    KINDLY advice me ASAP.

    Really if your case is not complicated like no major issues as in children and many divorces then yes you can do it yourself. As long as you have no ghosts in your closet then do it yourself. Saves a lot of money and it really is not that hard. All the guides are on here for you to follow so give it a go. And yes we did ours on our own and never had problems.

      K-1 visa and hiring a Lawyer

      My case is pretty simple .We both divorced i have one daughter and he has 2 boys.I am 3 yrs older than him but we have good understanding due to same culture,religion and values.
      The only thing is his older son turn 18.He is 17 yrs and 2 months old and i dont know if the K-1 suitable or K-3 is more safer to bring the kids with him.
      I have no idea which way to go to avoid complications and delay.
      Any feed back please.

        HHmmm you need to get the 129f petition done now before he turns 18 as after that you will have problems. Or if you get married now and you can file CR1 for your husband and for his boys might be easier. Hopefully someone else can chime in for you as we had no kids involved in ours. I just know that children have to be under 18 as after that they are adults and would have to be petitioned by your husband after he is LPR

          If i am not mistaken the kid can come in Spouse(k-3)Visa before he celebrates his 18th birthday while in K-1 Fiance visa he should be under 21.
          That is the reason I am thinking of to getting engaged so the kids will be safer.
          I am open for both options but fiance visa feel more suitable to me but still need advice.because no idea what is the best option.
          Any guidance would be greatly appreciated

            Honestly, I would file everything without a lawyer. Do you have the step-by-step guide?


            My fiance and I have been using this as our guide and are filing soon. She has a child but that's nothing, we simply added the child's name one of the documents.

              The Act defines a “child” as “an unmarried person under twenty-one years of age.” Section 101(b)(1) of the Act, 8 U.S.C. § 1101(b)(1) (2006). This definition includes a stepchild, provided the child had not reached the age of 18 years at the time the marriage creating the status of stepchild occurred. Section 101(b)(1)(B) of the Act. No separate adoption is required for a stepchild to be considered a “child.”

              That means your fiance can bring his children until they are 21 years old. He can get K1 and they get K2. You marry in the US within 90 days of their arrival. You list the children on your petition. They get a visa because their father does andthey are joining him.

              If your marriage occurs before the children turn 18 years old, then they qualify as your step-children and you can petition them as immediate family members...your spouse and step-children. So if you intend to marry before applying, do so before the child turns 18 or he will NOT be your stepchild for immigration purposes. You can marry anywhere you choose and your husband would be getting a CR1 visa.

              Please forget the K3 visa. They are all but obsolete and you are wasting time studying it.

              Other questions: I did the whole process without one problem by myself. It was all quick with no mistakes or delays. BUT I can read and understands forms, instructions, and the government websites quite well. I never had to ask a question on a forum because I understood it all. Nobody can answer for you as to how well you can follow instructions. Your writing sounds like English is not your native language. You aren't grasping the terms of the different visas so it is not going to get any easier and their are many details.
              • Pick a visa and download the forms and instructions and just try to fill them out with a pen for practice.
              • Follow the guidelines under visas on this website
              • Make a list of all the documents you will need to provide.. My petition was over 50 pages of paper.
              • Look at the I864 Affidavit of Support. Fill it out for practice and see if you make enough salary per year to sponsor 3 immigrants plus your family--5 people. $32,712 . If you don't then figure out how you will meet the requirement.


              If all of that goes easily for you, then you will know you will be ok doing it without the help of a lawyer.

                Yes, a Lawyer is needed in file a petition...
                The procedure begins by filing the case which may or may not be preceded by a legal notice to the company.Engage a lawyer as the company will surely have one. You can also get the amount you incurred on your availing the services of your lawyer. No forum will provide you a lawyer. You will have to engage your own lawyer. The amount of compensation can be decided by your lawyer only at the time of filing the case. The expenses will be the fees of your lawyer. It may take around 6 months in the court.
